Consumer Proposal in Quebec

Who Is Eligible to Make a Consumer Proposal?

  • A physical person with total consumer debts less than $250,000 excluding the principal residence.
  • It is possible to make a joint proposal.

Who is Authorized to Act as Administrator of the Consumer Proposal?

A Licensed Insolvency Trustee.

What is the Duration of the Consumer Proposal?

The maximum duration is 5 years (60 months).

What are the Conditions Required for the Proposal to Be Accepted?

  • There is a 45-day period during which creditors may file evidence of claims, request calling of a meeting of creditors and vote on the proposal.
  • The proposal is deemed to be accepted at the end of the 45-day period if the Insolvency Trustee administering the proposal has received no request to call a meeting of creditors.
  • In the event of a meeting of creditors, a majority of debt dollars must vote in favour of the proposal for it to be accepted.
  • Once the proposal is presumed accepted or is actually accepted by the creditors, an additional period of 15 days is required for the proposal to be presumed to have been accepted by the Court.

  • The proposal is based on the debtor’s assets and ability to pay.
  • The proposal may be subject to an amendment over the course of implementation.
  • The costs of the consumer proposal are established by the Bankruptcy and Insolvency Act and payable out of the payments provided for in the proposal.
  • Bankruptcy is avoided.
